Adventure Activity Waiver &
Assumption of Risk
Last updated: July 21, 2026 · DRAFT — Not yet reviewed by a licensed attorney
This document explains the physical risks involved in certain adventure and outdoor activities offered by Amanah Vacations, and asks you to confirm that you understand and voluntarily accept those risks before participating. Please read it carefully. If you do not understand any part of it, ask us before your activity begins — not during.
1. Activities This Covers
This waiver applies specifically to the following categories of activities when booked through Amanah Vacations:
- Cenote swimming, snorkeling, and diving
- Open-water and reef snorkeling
- ATV and zipline activities
- Yacht, boat, and other water-based excursions
- Helicopter tours
It does not apply to purely leisure activities with no meaningful physical risk (such as a guided city walk or a restaurant reservation), which are instead covered by our general Terms & Conditions.
2. Who Can Participate
In accordance with Mexican tourism regulation (NOM-011-TUR-2001), the following applies to adventure activities:
- Participants must be in adequate physical health to safely take part in the specific activity booked. If you have a heart condition, are pregnant, have recent injuries or surgeries, or any other condition that could be affected by physical exertion, water activities, or altitude, please tell us before booking so we can advise you accordingly.
- Some activities have minimum age requirements or require adult supervision for minors — these will be communicated to you at the time of booking for the specific activity.
- Amanah Vacations and our activity partners reserve the right to refuse participation to any guest who, in the reasonable judgment of our guides or operators, appears unfit or unsafe to participate on the day of the activity.
3. Safety Information
Before each activity, our guides or the third-party operator's staff will provide a safety briefing covering the specific activity, the equipment provided, and the rules you must follow. You are required to:
- Attend and pay attention to the full safety briefing before the activity begins
- Wear and correctly use any safety equipment provided (life jackets, helmets, harnesses, etc.)
- Follow all instructions given by guides and staff during the activity
- Inform your guide immediately of any injury, discomfort, or concern during the activity
4. Inherent Risks
Adventure and outdoor activities carry risks that cannot be completely eliminated, even when conducted safely and professionally by experienced guides and operators. Depending on the specific activity, these risks may include:
This list describes common categories of risk and is not exhaustive. Unexpected or unusual risks may also occur.
5. Your Acceptance of These Risks
By participating in any activity listed in Section 1, you confirm that:
- You have read and understood the risks described in Section 4
- You are voluntarily choosing to participate with full knowledge of these risks
- You are in adequate health to participate, as described in Section 2
- You will follow all safety instructions given by guides and staff
- You understand that Amanah Vacations and its third-party activity partners cannot guarantee your safety, only that reasonable, professional safety measures will be followed
6. What This Document Does — and Does Not — Limit
To the extent permitted under Mexican law, by acknowledging this document you agree that Amanah Vacations and its third-party activity partners are not liable for injury, loss, or damage arising from the ordinary, inherent risks of these activities described in Section 4, provided that reasonable safety measures were followed.
This document does not, and cannot, waive liability for: gross negligence (culpa grave) or willful misconduct (dolo) by Amanah Vacations, our staff, or our activity partners. Under Article 2106 of the Mexican Federal Civil Code, liability arising from willful misconduct can never be waived by agreement, and courts generally treat liability for gross negligence the same way. Nothing in this document should be read or presented as eliminating those protections, and your rights under Mexican consumer protection law (Ley Federal de Protección al Consumidor) remain fully intact regardless of anything in this document.
7. Minors
Where a minor (under 18) will participate in any activity covered by this document, a parent or legal guardian must review and acknowledge this document on the minor's behalf, and confirms they have the legal authority to do so. The parent or guardian remains responsible for supervising the minor throughout the activity unless otherwise instructed by guides or staff.
8. Acknowledgment
By checking the box(es) below at the time of booking, or by signing this document in person before your activity, you confirm:
- I have read and understood this Adventure Activity Waiver & Assumption of Risk document in full.
- I voluntarily accept the inherent risks described in Section 4 for the activity/activities I am booking.
- I confirm that I (and any minors in my care) am in adequate health to safely participate.
- I understand this document does not waive Amanah Vacations' liability for gross negligence or willful misconduct, and does not limit my rights under Mexican consumer protection law.
